MEICET Software User Agreement

Article 1. Special Notes
1.1 Shanghai May Skin Information Technology Co., LTD. (hereinafter referred to as the “MEICET”) special remind you before registering as a user, please read the “MEICET Software User Agreement” (hereinafter referred to as the “Agreement”), to make sure you fully understand this agreement, including the MEICET of exempted from the liability and limit the terms of the users’ rights. Emphasis shall be placed on reading and understanding the highlighted fonts, italics, underscores, color marks, and other provisions. Please read carefully and choose to accept or not accept this agreement. Unless you get all the terms of this agreement, you will have no right to register, log in or use the services covered by this agreement. Your registration, login, and use shall be deemed as acceptance of this agreement and you agree to be bound by the terms of this agreement.
1.2 This agreement stipulates the rights and obligations between MEICET and users regarding the MEICET software services (hereinafter referred to as the “services”). “User” means legal persons and individuals who have registered, logged in, and used the service.
1.3 This agreement shall be updated from time to time by MEICET. Once the updated terms and conditions are published, they shall replace the original terms and conditions without notice. Users can check the latest version of the agreement on MEICET’s official website (http://www.meicet.com/). If you do not accept the updated terms, please stop using the service immediately and if you continue to use the service will be deemed to accept the updated agreement.
1.4 Once the user is registered, logged in, and used, the information and data provided by the user shall be deemed as a universal, permanent and free license to use.
1.5 Before testing their customers’ skin, users shall inform the user that MEICET software will collect information including portraits, and MEICET and its partners have the right to use it. The legal user shall be liable for the failure to perform the obligation of notification.
Article 2. Account Registration and Use Management
2.1 After successful registration, the user can change his/her information through the “Admin Center” interface, and he/she shall be liable for any loss caused by failure to do so in time. Users should properly manage their own passwords, and should not tell their passwords to other third parties. If the password is lost, please inform us in time and solve it according to the MEICET instructions.
2.2 Users shall not take advantage of the services provided by MEICET to conduct the following behaviors:
(1) change, eliminate or damage any advertising business information provided by MEICET without permission;
(2) using technical methods to set up fake accounts in batches;
(3) infringement of intellectual property rights of MEICET and the third parties;
(4) submit or publish false information, embezzle others’ information, impersonate or use others’ names;
(5) spread advertisements or obscene and violent information without MEICET permission;
(6) sell, rent, lend, distribute, transfer or sublicense software and services or related links, or profit from the use of the software and services or the terms of the software and services, without MEICET authorization, whether such use is direct economic or monetary gain;
(7) violation of the management rules of MEICET, including but not limited to the above behaviors.
2.3 Any of the above violations, MEICET has the right to disqualify the user or the products or rights and interests obtained by the user from participating in the activity, stop the service and close the account. In case of any loss caused to MEICET or its partners, MEICET reserves the right to pursue compensation and legal settlement.
Article 3. User Privacy Protection Statement
3.1 Privacy information mainly refers to the information acquired by users in the process of registration and use of MEICET software services, including user registration information, detection information (including but not limited to user portrait, location information, etc.), or information collected with user’s permission in the process of using MEICET software.
3.2 MEICET will provide corresponding protection to the above information within its own technical scope, and will always actively take reasonable measures such as technology and management to ensure the security and effectiveness of user accounts, but also ask users to understand that there are no “perfect security measures” on the information network, so MEICET does not promise absolute security of the above information.
3.3 MEICET shall use the collected information in good faith. If MEICET cooperates with a third party to provide relevant services to users, it has the right to provide such information to the third party.
3.4 MEICET has the right to publish experiences of customers, product discussions obtained from software use, and the pictures of customers by hidden protection through technology (such as Mosaic or alias) on the Internet, newspapers, magazines, and other major news media platforms for product promotion and use; however, permission must be obtained from the user if the user’s real information or all clearly visible portraits are to be disclosed.
3.5 Users and the customers of the users shall agree that MEICET uses the users’ personal privacy information in the following matters:
(1) timely send important notices to users, such as software updates and changes to the terms of this agreement;
(2) conduct an internal audit, data analysis, research, etc.;
(3) MEICET and the cooperative third party shall share the above information on the premise of jointly protecting the privacy of the customers and the users;
(4) within the scope permitted by laws and regulations, including but not limited to the items listed above.
3.6 MEICET shall not disclose the personal privacy information of users and customers of the users without permission, except for the following specific circumstances:
(1) disclosure as required by laws and regulations or required by administrative authorities;
(2) the user has the right to use the products and services provided and shall agree to share the above information with the partners;
(3) users disclose their personal and customer private information to a third party by their selves;
(4) the user shares his/her password or shares his/her account and password with the others;
(5) private information disclosure due to hacker attacks, computer virus invasion, and other reasons;
(6) MEICET finds that users have violated the terms of service of the software or other usage regulations of the MEICET website.
3.7 The software of Cooperative partners of MEICET contains links from other websites. MEICET is only responsible for privacy protection measures on the MEICET software APP and shall not take any responsibility for privacy protection measures on those websites.
3.8 MEICET reserves the right to send information about company activities or related company activities to users by Email, SMS, WeChat, WhatsApp, post, etc. If the user does not want to receive such information, please inform MEICET with a statement.
Article 4. Service Contents
4.1 The specific content of the software service shall be provided by the company according to the actual situation, including but not limited to:
(1) skin test (remote test can be provided in the future under the condition of technical support): it means to analyze and test by collecting the picture information of the tester’s front face;
(2) advertisement broadcast: users and their customers can view advertisement information on the software interface, including advertisements provided by MEICET, third-party suppliers, and partners;
(3) related product promotion: users can reach an agreement with MEICET on product promotion services according to their own needs;
(4) payment platform: MEICET may add platform services according to users’ needs in the future, and then modify this agreement according to the situation.
4.2 Users can learn about relevant service content at MEICET’s official website: (http://www.meicet.com/);
4.3 Under the premise of complying with relevant laws and regulations, according to the requirements of cooperative advertisers, MEICET has the right to determine the advertising content seen by users on the interface of MEICET software; Users can also enter into an advertising agreement with MEICET to help them push ads to their customers.
Article 5. Service of Alteration, Interruptions, Terminates
5.1 The business is interrupted due to technical reasons such as equipment repair or replacement, failure, and communication interruption. MEICET may notify the user before or after the event.
5.2 MEICET temporary interruption of business will be announced on our website (http://www.meicet.com/).
5.3 MEICET may terminate this Agreement unilaterally when the MEICET User encounters the following conditions: Cancellation of the user’s eligibility to continue to use MEICET’S product and services:
(1) the user has been canceled, revoked, or caught in a major economic crisis, litigation, arbitration activities, etc.;
(2) stealing information from other companies;
(3) providing false information when registering users;
(4) hinder the use of other users;
(5) a pseudo-claimer is a MEICET staff member or manager;
(6) unauthorized changes to MEICET’s software system (including but not limited to hacking, etc.), or threats to invade the system;
(7) spreading rumors without authorization, using various means to destroy MEICET’s reputation and hinder MEICET’s business;
(9) use MEICET products and services to promote spam advertising;
(10) other acts and violations of this Agreement.
Article 6. Intellectual Property Protection
6.1 The intellectual property rights of this software belong to the MEICET company, and anyone who infringes the copyright of the MEICET company will bear corresponding responsibility.
6.2 MEICET’s trademarks, advertising business, and intellectual property rights related to advertising content are attributed to MEICET. The information content obtained by users from MEICET cannot be copied, published, or published without permission.
6.3 The User agrees to all the information such as the product use experience, product discussion, or pictures published on the MEICET platform, except for the right of authorship, publication, and modification (including but not limited to: reproduction rights, distribution rights, rental rights, Exhibition rights, performance rights, screening rights, broadcasting rights, information network communication rights, filming rights, adaptation rights, translation rights, compilation rights, and other transferable rights that should be enjoyed by copyright owners) are exclusive and exclusive to MEICET, and Agree that MEICET will take any form of legal action in its own name for the protection of the rights and obtain full compensation.
6.4 MEICET and licensed third parties have the right to use or share the product experience, product discussions, or pictures published by users on this platform, including but not limited to APP software, websites, e-magazines, magazines, and publications. And other news media.
Article 7. Exception Clause
7.1 The MEICET software is not absolutely scientific and valid for the user’s skin analysis, and only provides users with references.
7.2 The text, pictures, audio, video, and other information of the MEICET advertising business are provided by the advertiser. The authenticity, accuracy, and legality of the information are the responsibility of the information publisher. MEICET only offers pushes without any guarantee and no responsibility for advertising content.
7.3 The user shall be responsible or recover from the third party’s transaction when the loss or damage is caused by the advertiser or transactions with third parties. MEICET will not be responsible for the loss.
7.4 MEICET does not guarantee the accuracy and completeness of external links, which are set up to provide convenience to users.
At the same time, MEICET is not responsible for the content on any web page, that the external link points to that is not actually controlled by MEICET.7.5 Users are required to ensure that all actions are implemented during the use of MEICET software, that all should comply with the national laws, regulations and other normative documents and the provisions and requirements of MEICET rules, do not violate the public interest or public morals, do not harm the legitimate rights and interests of others, and do not violate this agreement and related rules.
If any violation of the above commitments has any consequences, it shall bear all legal liabilities in its own name. MEICET reserves the right to recover the users and users.
Article 8. Others
8.1 MEICET solemnly reminds users to note that MEICET liability is waived in this agreement. And terms that restrict user rights, please read them carefully, and consider risk independently.
8.2 The validity, interpretation, and resolution of this agreement shall apply to the laws of the People’s Republic of China. If there is any dispute or dispute between the user and MEICET, First of all, it should be resolved through friendly negotiation.
8.3 Nothing in this Agreement shall be valid for any reason or for no reason, and shall be binding on both parties.
8.4 Copyright and other rights to modify, update, and final interpretation of the relevant disclaimers of this Agreement are owned by MEICET.
8.5 This Agreement shall apply from May 30, 2022.
